1. Definition of terms
In this user agreement, the following terms are used in the following meanings:
1.1. Hotel “White Square” – Malashenko G.V., a private entrepreneur, registered and operating in accordance with the laws of Ukraine.
1.2. Guest – any legally capable individual who is at least 18 (eighteen) years old at the time of the conclusion of the Agreement.
1.3. Services – temporary accommodation (accommodation) services provided by hotels and similar temporary accommodation facilities.
1.4. Agreement – this User Agreement.
1.5. Accommodation means an accommodation facility provided to the Guest.
1.6. Booking – the reservation of an Accommodation facility for the Guest for a specified period of time.
1.7. Website – a web page on the Internet at the following link: https://hotel-kyiv.com/.
1.8. Payment system – a legal entity that processes and executes payments by means of bank cards and has the appropriate license of the National Bank of Ukraine to perform such actions.
1.9. Promotional Code – a unique code generated by the Belyi Kvadrat Hotel or by order of the Belyi Kvadrat Hotel, which provides the Guest with a discount in the amount determined by the Bilyi Kvadrat Hotel for the Services.
2. Subject of the Agreement and its general provisions
2.1. The Belyi Kvadrat Hotel provides, and the Guest accepts and pays for the Services provided by the Belyi Kvadrat Hotel to the Guest.
2.2 This Agreement is a public contract concluded between the Belyi Kvadrat Hotel and the Guest and regulates the relations between the Belyi Kvadrat Hotel and the Guest regarding the provision of the Services.
2.3. This Agreement in its current version is posted on the Website in Ukrainian and translated into English and Russian, which have equal legal force. In case of any discrepancies, the context in the original language shall be taken into account.
2.4. This Agreement is concluded between the Belyi Kvadrat Hotel and the Guest simultaneously with the Guest’s making a Reservation.
2.5. By making a Reservation, the Guest confirms that he/she has read and fully agrees with the terms of this Agreement and the Privacy Policy, accepts the offer to conclude the Agreement and agrees to the processing of his/her personal data.
2.6 By entering into the Agreement, the Guest confirms that he/she has the appropriate scope of rights to enter into it, by law or other regulatory act, court decision, or is not otherwise restricted in the right to enter into and perform the Agreement.
3. Booking
3.1. To conclude the Agreement and receive the Services, the Guest must make a Reservation through the Website. The Guest cannot make a Reservation without agreeing to the Agreement and the Privacy Policy.
3.2. During the Booking, the Guest shall indicate his/her:
– first and last name;
– e-mail address;
– phone number.
3.3 The Belyi Kvadrat Hotel guarantees to the Guest that it will not use the information provided by the Guest during the Booking for any other purpose than to provide the Services and the purposes provided for in this Agreement.
3.4. The result of the Guest’s Booking is the reservation of the Accommodation facility for the Guest for a specified period of time.
3.5. The Guest independently ensures the safety of the information necessary to access their own Reservation and all information contained therein.
3.6. The Bilyi Kvadrat Hotel guarantees to the Guest that it will not take any actions to transfer information about the Guest’s Reservation and the information contained therein, except in cases and to the extent necessary to provide such information:
– to third parties to ensure that the Guest receives the Services;
– at the request of law enforcement agencies;
– at the request of the judicial authorities;
– in other cases determined by the legislation of Ukraine.
3.7. Bilyi Kvadrat Hotel is not responsible for the consequences of the Guest’s loss of information or access to information about his/her Booking.
4. Cost of services and payment procedure
4.1 Belyi Kvadrat Hotel provides the Guest with the Services on a paid basis.
4.2. The White Square Hotel independently determines the cost of its own Services.
4.3. The cost of the Services of the White Square Hotel is indicated on the Website.
4.4. The cost of the Services may vary depending on the Accommodation chosen by the Guest.
4.5. The cost of the Services is set in the national currency of Ukraine – hryvnia.
4.6. The cost of the Services may be changed unilaterally by the Belyi Kvadrat Hotel until the Guest makes payment.
4.7. Payment for the Services can be made by the Guest only in non-cash form.
4.8. When paying for the Services in a non-cash form, the Guest will be redirected to the website of the Payment System, through which the Guest’s funds will be accepted and transferred.
4.9. The Belyi Kvadrat Hotel does not have access to and does not collect, record, use or process information that has or may have a direct or indirect relation to the Guest’s bank cards or other payment information.
4.10. In case of any questions or problems related to the payment for the Services, the Guest shall address such questions or solve such problems directly with the Payment System.
4.11. Belyi Kvadrat Hotel has the right not to provide the Services to the Guest who has not paid for the Services.
5. Promo codes
5.1. Belyi Kvadrat Hotel may provide the Guest with Promo Codes.
5.2. In order to use the Promo Code, the Guest must enter it in the “Add Promo Code” field on the Website before making a payment.
5.3. Terms of use of Promo Codes:
– Promo Codes may not be copied, sold, transferred or made public;
– Promotional codes may be invalidated or canceled by the White Square Hotel at any time and for any reason or no reason;
– Promo codes are not subject to exchange or refund;
– Promo codes are not restored in case of their loss;
– Promo codes cannot be exchanged for cash or any other benefits.
6. Refusal to provide the Services
6.1. Belyi Kvadrat Hotel has the right to refuse to provide the Services to the Guest (including canceling the Guest’s reservation) in the following cases:
– Violation by the Guest of the terms of this Agreement;
– Providing false information by the Guest during the Booking;
– If the Guest’s actions lead or may lead to a violation of the rights of the White Square Hotel or the rights of third parties;
– If the Guest’s actions lead or may lead to a violation of the current legislation of Ukraine;
– If the Guest’s actions lead or may lead to claims from third parties to the Belyi Kvadrat Hotel.
7. Refunds
7.1. The Guest has the right to refuse to receive the Services and request a refund in the cases specified in the Agreement. To avoid any misunderstandings, we would appreciate your attention to the following:
No refunds are made:
– If the guest cancels the reservation in less than 1 day, the prepayment is not refundable.
– If the guest arrives and decides to leave early, the paid nights are not refundable.
– In the event that the guest simply does not show up (and does not cancel the reservation in advance), the full amount of the reservation will be charged, which is non-refundable.
7.2. In order to request a refund, the Guest must provide the following information and documents to the Belyi Kvadrat Hotel:
Last name, first name and patronymic;
Registration number of the taxpayer’s account card;
Registration address;
Bank account number in IBAN format and the number of the bank card from which the payment was made;
Scanned copy of the Payment System receipt confirming payment for the Services.
7.3. In case of receipt of a request for a refund within the period specified in this Agreement, provision of information and documents specified in this Agreement, the White Square Hotel shall refund the funds to the Guest within 30 (thirty) calendar days from the date of receipt of such a request.
7.4. Failure of the Guest to comply with the term specified in this Agreement and/or failure of the Guest to fulfill any of the conditions specified in this Agreement shall be grounds for refusal to refund the funds.
8. Booking rules
8.1. Hotel “White Square” establishes the following rules for check-in and check-out of the Guest:
Check-in: 14:00;
Check-out: 12:00;
10. Responsibility
10.1. The White Square Hotel is not responsible for:
The inability to provide the Services, for reasons beyond the control of the hotel “White Square”;
Actions of any third parties;
Any damage or loss caused through no fault of the Belyi Kvadrat Hotel.
10.2. Belyi Kvadrat Hotel is responsible for violation of the terms of the Services.
10.3. The guest is responsible for:
Destruction or damage to the property of the Belyi Kvadrat Hotel;
Use of the Accommodation facility in violation of the terms of this Agreement;
10.4. The Belyi Kvadrat Hotel does not guarantee and is not responsible for the possibility or impossibility of making a payment by bank card using the Payment System, for the proper operation of the Payment System, for ensuring the safety and security of information provided to the Payment System by the Guest to make a payment by bank card.
10.5. The Belyi Kvadrat Hotel is not responsible for any material or moral damage, any direct or indirect losses that have been or could have been caused to the Guest as a result of force majeure.
10.6. The Guest shall be responsible for the risk of accidental destruction and/or accidental damage to the property of the Belyi Kvadrat Hotel within the value of such property or within the cost of restoration of such property. Payment of the cost of restoration or property destroyed through the fault of the Guest must be made by the Guest before the Guest departs or within 1 (one) banking day from the date of receipt by the Guest of the relevant request from the Belyi Kvadrat Hotel. In case of failure of the Guest to pay the cost of restoration repairs or property destroyed through the fault of the Guest within the period provided for in this paragraph, the Guest is additionally obliged to pay a fine to the Belyi Kvadrat Hotel in the amount of 10% of the cost of restoration repairs or property destroyed through the fault of the Guest for every 10 calendar days of delay.
10.7. Notwithstanding any provisions set forth in this Agreement, the Belyi Kvadrat Hotel declares, and the Guest accepts and agrees that any material liability of the Belyi Kvadrat Hotel will be limited to the amount of the cost of the Services paid by the Guest.
11. Collection and recording of personal data
11.1. All features that are directly or indirectly related to the processing and protection of the Guest’s personal data are determined by the Privacy Policy posted on the Website.
11.2. By making a Booking, the Guest confirms that he has read and fully agrees with the Privacy Policy.
12. Application of the law
12.1. This Agreement and the relations of the Parties not regulated by this Agreement shall be governed by the laws of Ukraine and international law recognized by the state of Ukraine in accordance with the established procedure.
13. Amendments to this Agreement
13.1. The Belyi Kvadrat Hotel has the right to unilaterally amend or supplement this Agreement, with or without notice to the Guest, and the Guest accepts such right of the Belyi Kvadrat Hotel and gives his irrevocable consent to the introduction of such amendments and supplements by the Belyi Kvadrat Hotel.
13.2. If the Guest continues to use the Services of the Belyi Kvadrat Hotel, it means that he unconditionally accepts the changes or additions made by the Belyi Kvadrat Hotel.
13.3 If the Guest does not accept the changes or additions made by the Belyi Kvadrat Hotel, he/she is obliged to notify the Belyi Kvadrat Hotel by sending a written notice to the address of the Belyi Kvadrat Hotel. In this case, the Guest shall not receive the Services and shall be entitled to a refund under the terms and conditions set forth in this Agreement.
14. Validity of the provisions
14.1 If the provisions of this Agreement differ from the provisions set forth on the Website (including, but not limited to) and/or additional terms of the Services not specified in this Agreement but indicated on the Website, the provisions set forth on the Website shall apply.
14.2 If one or more provisions of this Agreement are declared invalid or void by a court, all other provisions shall remain in full force and effect.
